In this respect, the purpose of this Privacy Policy ("the Policy") is to inform you of the means used by the Editor to process your Personal Data as defined below on the AUPAIRTRIP Application (hereinafter "the Application"), in compliance with the French Data Protection Act n°78-17 of January 6, 1978, aux fichiers et aux libertés as amended by the Act of June 20, 2018 and supplemented by its implementing decree of August 1, 2018, as well as Regulation n°2016-679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (the "Regulation").

The Policy may be modified at any time, to comply with any regulatory, case law, editorial or technical developments. The Editor therefore recommends that you refer to the latest version of the Policy before browsing the Site.

The terms defined in the Terms and Conditions of Use and the Terms and Conditions of Sale apply to the present privacy policy.

  1. Who is responsible for processing your data?

The person responsible for processing (the "Data Controller") is, within the meaning of the Regulations, the person who determines the means and purposes of the Processing.

The Editor is the Data Controller when it processes your Data for the creation of the User Account on the Application or when it enables the performance and benefit of its Services.

All Users are concerned by the Data Processing.

In accordance with the principles of proportionality and minimization, the Editor only collects Data necessary to achieve its intended purposes.

The Editor legitimate interest in ensuring the operation and availability of the Site, and the User's consent in the case of cookies used to provide audience measurement, anonymous statistics and/or for marketing purposes.

Data processed as part of browsing the Site and using the Services are communicated to :

The Editor service providers only have access to Data that is strictly necessary for the performance of their duties.

  1. How long is your Data kept?

As a general rule, User Data is kept for the time necessary to achieve the purpose for which it was collected, in accordance with applicable laws and regulations.

The Editor retains your Data for the following purposes:

Data retention periods:

Account creation and profile data

For the duration of the Account's existence, until it is deleted by the User or the Editor.

In the case of an inactive account for an uninterrupted period of 2 years, the Editor will contact the User concerned to give him/her the opportunity to express his/her wish to maintain his/her account on the Site, before the Editor proceeds to its deletion.

Execution of Services and Additional Services:

  • Identity certification
  • Payment management

Up to 2 years from the end of the contractual relationship in the event of reactivation of the Account.

At the end of this period, the Data will be kept in intermediate storage for the duration of the applicable limitation period, i.e. 5 years.

Geolocation service

Immediate deletion on deletion of the Account.

Up to 2 years from the end of the contractual relationship in the event of reactivation of the Account.

Sending newsletters and special offers to Users

Until the User has indicated his opposition to receiving e-mails, and in any event for a maximum of 3 years from the last contact with the User.

Up to 13 months from the date of collection of the Data.

  1. What security measures are in place?

In its capacity as data controller, the Editor undertakes to take all necessary precautions to protect the security and confidentiality of the Data and, in particular, to prevent it from being altered, distorted or accessed by unauthorized third parties.

All Data is hosted in France or in the European Union.

Payment providers

Payment for purchases is made solely and directly via the Application's download Stores. The Editor has no access to Users' bank details.

  1. What are your rights under the Regulations?

As a person concerned by the processing of your Data, you have the following rights:

- Right of access: the right to request confirmation that your Data is or is not being processed and, where applicable, access to said Data and information relating to its processing.

  •  Right of rectification: the right to request rectification of inaccurate Data.
  •  Right to erasure: the right to request the erasure of your Data.
  •  Right to limit Processing: the right to ask the Editor to limit the processing of your Personal Data.

- Right to object to Processing: if you wish your Data to no longer be processed by the Editor. In this case, you must put forward reasons relating to your particular situation.

- Right to portability: the right to receive certain Data that the Editor has collected directly from you and to pass them on to another Data Controller.

  • Right to formulate general and specific directives concerning the fate of your Data after your death.

- Right to withdraw consent given to the Editor, in particular with regard to cookies and commercial prospecting.
